This Privacy Policy governs the privacy practices of Indian Nurses Association of New York (collectively “INA-NY,” “we,” “our” or “us”) related to our website located at https://www.inany.org/, (collectively, the “Site”) and member accounts and related services (collectively, the “Services”).

This Privacy Policy (‘Policy’) governs our use of your information and describes how we collect, process, use and transfer your information when you access our Site and Services. By accessing our Site or using our Services, you explicitly consent to this Policy and our Terms of Use, which is fully integrated herein.

 

A. Collection of Information

We collect information about you directly from you and automatically through your use of our Site and Services.  We may combine information automatically collected with other information that we have collected about you including from publicly available sources.

The Site and Services are not directed to children under eighteen (18) years of age and we do not knowingly collect personal information from children under 18. If we discover that a child under 16 has provided us with personal information, we will promptly delete such personal information from our systems.

Information We Collect Directly From You. When you interact with our Site and Services, including for example using our “Contact Us” feature or submitting a “Membership Application”, you voluntarily provide certain information to us. We may collect information including but not limited to, your name, e-mail address, phone number, date of birth, last four digits of your social security number If you register for an account or opt to pay your bill online, you may also provide your account number, and other financial information. Further, if you utilize our “Career Center” feature, all information provided on your resume is subject to this Policy.

Information Collected Automatically. Like many websites, we and our service providers may use cookies, web beacons and other technologies to receive and store certain types of information when you interact with us through your computer or mobile device subject to your opt-out preferences (see “Your Choices; Opt-Out; Do-Not--Track Disclosures; Third-Party Tracking” section below). Using these technologies helps us customize your experience with our Services, improve your experience, and tailor marketing messages. Here are some of the types of information we may collect:

  1. Log & Device data. When you use our Site or Services, our servers automatically record information (“log data”), including information that your browser sends whenever you visit our Site. This log data may include the web address you came from or are going to, your device model, operating system, browser type, unique device identifier, IP address, mobile network carrier, and time zone or location.  Whether we collect some or all of this information often depends on what type of device you’re using and its settings. For example, different types of information are available depending on whether you’re using a Mac or a PC.  To learn more about what information your device makes available to us, please check the policies of your device manufacturer or software provider.

  2. Cookies and Other Tracking Mechanisms. Depending on how you’re accessing our products and subject to your opt-out preferences, we may use “cookies” (a small text file sent by your computer each time you visit our Site, unique to your account or your browser) or similar technologies to record log data.  When we use cookies, we may use “session” cookies (that last until you close your browser) or “persistent” cookies (that last until you or your browser delete them).  For example, we may use cookies to keep you logged in to our Site. Some of the cookies we use are associated with your account (including personal information about you, such as the email address you gave us), and other cookies are not.  To help us make emails more useful and interesting, we often receive a confirmation when you open email from us if your computer supports such capabilities.  You can opt out of receiving emails from us.   3. Other Web Site Analytics Services. Subject to your opt-out preferences (see “Your Choices; Opt-Out; Do-Not--Track Disclosures; Third-Party Tracking” below), we use third-party service providers such as Google Analytics to provide certain analytics and user interactions services to us in connection with our operation of our Site and Services, including the collection and tracking of certain data and information regarding the characteristics and activities of visitors.  You may opt-out of Google Analytics’ cookies using Opt-Out Features on Google’s websites.

  4. Information We Receive from Third-Parties. In addition to information we collect from you, we may receive information about you (including personal information) from third-parties.  Please also note that if you are on another website and you opt-in to receive information from us, that website will forward to us your email address and other information about you so that we may contact you as requested. 

B. How We Use Your Information

The information we collect from you enables us to improve our Services by understanding how you use and interact with our Services. We also use your information to:

  1. Providing Our Services. We use information we collect to fulfill your requests and provide access to our Services.

  2. Maintaining and Improving Site and Services. We may use information we collect to maintain and improve the features of our Services and enhance user experience.

  3. Tailoring the Content. We may use information we collect to provide Services based on your location and interests including but not limited to search results and advertising content.

  4. Research and Innovation. We may use information we collect to conduct research and support innovation;

  5. Preventing and Detecting Fraud. We may use information we collect to investigate and defend against fraudulent, abusive, or unlawful activities.

  6. Communication. We may use information we collect to communicate with you. The purpose of such communications may be to update you about our services or to send marketing and promotional messages. C. Sharing of Information

We may share your personal information with third-parties for the following purposes:

  1. Managing and Providing Our Service. We may use third-party service providers in connection with operating and improving our Site and Services. We may disclose your information to such third-party service providers only to the extent necessary for them to fulfill their obligations under this section.

  2. Completing a Transaction of Merger, Acquisition, Sale or Transfer of Assets, Or Bankruptcy. If we sell or transfer all or a part of our business or assets, or are otherwise involved in a merger, reorganization, acquisition, dissolution, liquidation, we may, as part of that transaction, transfer your information to the party or parties and their advisors involved in that transaction.

  3. Complying with Legal Obligations. We may disclose your personal information to any competent authority including but not limited to the law enforcement body, regulatory, government agency, court or other third-party where we have a reason to believe that such disclosure is necessary to (i) comply with and enforce the law or legal process, including contractual obligations, and our policies; (ii)  protect the rights, property and safety of, or to prevent fraud or abuse of our platform or others, and (iii) respond to requests from public and government authorities.

  4. To Provide Advertisements and Promotional Content. We may share your information with third-parties who may further use this information to understand your preferences and send you relevant advertising and promotional content[1] .

D. Information Security

We use reasonable precautions, including technical, administrative, and physical procedures, to protect personal information from loss, misuse, or alteration. Guaranteed security does not exist on the Internet or offline, but we do make commercially reasonable efforts to handle such information consistent with this Policy and applicable laws.  Due to the design of the Internet and other factors outside our control, we cannot guarantee that communications between you and our servers will be free from unauthorized access by third-parties.

E. Information Retention

We retain your personal information to (a) fulfill the purposes for which the information was collected, (b) comply with our legal obligations, (c) prevent fraud, (d) resolve disputes, (e) enforce our policies and (f) maintain our relationship with you.

F. Third-Party Links and Services

The Site and Services may contain links to other third-party websites, which may have their own privacy policies and terms and conditions that are not governed by this Policy. We are not responsible for the privacy practices or the content of any website(s) owned and operated by any such third-parties. Other websites may collect and treat information collected differently, so we encourage you to carefully read and review the privacy policy for each website you visit. Any links from our Services to other websites, or references to products, services or publications other than ours, do not imply the endorsement or approval of such websites, products, services or publications by INA-NY.

G. Your Choices; Opt-Out; Do-Not--Track Disclosures; Third-Party Tracking

  1. Opt-Out. If you receive any promotional email communication from us, you will be given the option to “unsubscribe” from receiving further email communications from us at any time.  Your option not to receive promotional and marketing material from us will not preclude us from corresponding with you, by email or otherwise, regarding existing or past business relationships with us, and will not preclude us from accessing and viewing your information in the course of maintaining and improving the Services. 

  2. Cookies. You can set your browser to refuse all or some cookies or alert when cookies are being sent.  If you disable or refuse cookies or block the use of other technologies, some parts of the Services may then be inaccessible or may not function properly. 

  3. Do-Not-Track. You can also manage how your mobile device, browser, computer, and other platforms and software share information by adjusting your privacy, security, WiFi and related settings.  For example, some browsers and devices have a Do Not Track feature that sends a signal to a website, analytics companies, ad networks, plug-in providers and other web services to stop tracking your activity.  Unless your browser or device settings are configured to make your activities invisible to usage analytics tools, we do not presently have the capability to omit you from usage analytics to the extent your browser only sends a “do not track” message and does not otherwise screen you from tracking without any action on our part.  For information regarding how to enable a Do Not Track setting if available on your devices, please see https://allaboutdnt.com. 

  4. Third-Party Tracking. Third-parties, other than our service providers, do not have authorization from us to track which websites, apps, or other online services you visit prior to and after visiting the Site or Services.  Please note, however, that we cannot control third-party tracking and there may be some third-party tracking that occurs without our consent or knowledge.

H. Users Outside of the United States

We are headquartered in the United States.  Personal information may be accessed by us or transferred to us in the United States or to our affiliates, business partners, or service providers elsewhere in the world.  If you are located outside of the United States, be advised that any information you provide to us will be transferred to and stored in the United States and that, by submitting information to us, you explicitly authorize its transfer and storage within the United States.  We will use reasonable measures to protect the privacy and security of personal information according to this Policy regardless of where it is processed or stored within the United States.

I. Children’s Privacy

Our Site and Services are intended for users who are at least 18 years of age and can legally enter into a binding contract. We do not knowingly collect, use or store any personal information from children who are under 16 years of age.

J. Policy Updates

We may periodically update this Policy in light of changing business practices, technologies and legal requirements. If we make any material changes to this Policy, we will notify you before the implementation of such changes and, where required by law, take your consent.
